Terms and Conditions

The offer and sale of products through the website www.caffestagnitta.com are governed by the following General Terms and Conditions of Sale. The General Terms and Conditions of Sale are formulated in accordance with the regulations on contracts concluded outside commercial premises, in particular with the provisions of Legislative Decree No. 206 of September 6, 2005 (Consumer Code).

Parties to the Contract
The parties to the contract are as follows:

• Stagnitta: I. STAGNITTA CAFFÈ by Marilù Stagnitta & C. S.N.C., located in Palermo, via A. Crescenzio 5/15, Business Register of the Palermo Chamber of Commerce, Tax Code and VAT number 05227850822.

• Customer: the final consumer, i.e., the individual acting for purposes unrelated to their business or professional activities, identified via the website www.caffestagnitta.com or by phone, who has placed an order accepted by Stagnitta.

Application and Modification of the General Terms and Conditions of Sale
By placing an order in the prescribed manner, the Customer declares to have read all the information provided during the purchase procedure and to fully accept the General Terms and Conditions of Sale. Stagnitta reserves the right to change the General Terms and Conditions of Sale by notifying customers on this page of the website. The applicable General Terms and Conditions of Sale are those in force at the time the order is placed. Any changes will be effective after publication on the website.

Registration on the Website
Registration with a username and password is optional. If the Customer does not wish to register, they can still complete a purchase: only the information necessary for the delivery and potential invoicing of an order will be required.

Characteristics and Prices of Products or Services
The images of the products may not perfectly represent their features but may differ in color, size, products, and accessories depicted. All supporting information for purchasing should be considered as general informational material, not referring to the actual characteristics of a specific product.
The products are offered at the price indicated on the site on the date the order is placed.
The prices are inclusive of VAT, which will be specified in detail on the purchase invoice, if issued.
The prices do not include shipping and delivery costs, which are indicated in the final section before submitting an order and specified in the order confirmation sent via email to the Customer.

Placing Orders
Orders may be subject to minimum or maximum quantity limits, and products are offered subject to stock availability.
Where applicable, promotional codes provided by Stagnitta and its partners are valid only for the products and during the period specified. Promotional codes are non-refundable and non-cumulative. To benefit from discounts and/or offers related to promotional codes, the code must be entered in the designated field when confirming the order on the website.
Orders from individuals under the legal age will not be accepted.
The steps to place an order and conclude the purchase contract are clearly highlighted in the sequence of pages on the website through explanatory texts and graphics.
Once payment is confirmed, the order cannot be canceled or modified.

Order Receipt Confirmation and Acceptance
Once an order is received, Stagnitta will automatically send a confirmation of receipt by email, summarizing the details of the order. After receiving an order, Stagnitta will check the availability of the ordered product and only after this verification will proceed with shipping the product.
If Stagnitta is unable to fulfill an order, it will promptly inform the Customer.
No right to compensation for damages or indemnity, nor any contractual or extra-contractual responsibility for direct or indirect damages to persons and/or things caused by the non-acceptance of an order, is granted to the Customer.

Accepted Payment Methods
Stagnitta accepts payment only through the following systems:

• Credit Card (American Express, Visa, or Mastercard): The total amount will be charged at the time of the order.

• PayPal: An online payment system that allows businesses or consumers with an email address to send and receive payments, upon registration. The payment is made through PayPal's payment platform.

Product Shipping
Stagnitta will ship the purchased products exclusively to the destination specified in an order. P.O. Boxes are not accepted.
Stagnitta will ship the ordered products via courier to the address provided by the Customer, approximately within 48 working hours from order receipt. Delivery generally occurs within 5 working days.
Delivery charges are invoiced based on the rates indicated on the website or communicated by Customer Service at the time the order is placed.
The recipient of the goods is responsible for paying taxes and customs duties in accordance with the regulations in force in the destination territory.
The courier is responsible for delivery. Stagnitta commits to collecting reports of missed or delayed deliveries via Customer Service at the number 091547317 and, if necessary, assisting the Customer in protecting their rights as per the law.

Acceptance of the Product by the Customer
Any damage to the packaging and/or product or discrepancies in the number of packages or information must be immediately contested by marking the delivery document accordingly. By signing the courier's document, the Customer certifies the external integrity of the product and the conformity of the delivery.
Any issues related to the actual physical integrity, correspondence, or completeness of the received products must be reported within 10 working days from delivery by sending an email to info@stagnittacaffe.it or by calling the Customer Service number +39 091547317.

Invoicing
An invoice will be issued for each order by a private Customer who has entered their tax code, and for each order by a professional or business Customer with a VAT number. To issue the invoice, the information provided by the Customer at the time of the order will be used. No changes to the invoice can be made after issuance. During the order process, the Customer must indicate whether the shipping address differs from the billing address. If the private Customer chooses not to enter their tax code, or if the professional or business Customer does not enter their VAT number, Stagnitta will not issue an invoice nor certify the payment with a receipt or fiscal receipt (Articles 22, paragraph 1 of DPR 633/72 and Article 2, letter oo of DPR 696/96).

Right of Withdrawal and Return Policy
Pursuant to Legislative Decree No. 21 of February 21, 2014, implementing Directive 2011/83/EU on consumer rights, the Customer can return the purchased product and obtain a refund of the amount actually paid.
The right of withdrawal can be exercised within 14 days of receiving the product by the following means:

1. Before the expiration of the above-mentioned period, the Customer must send a registered letter with return receipt to Stagnitta or provide another explicit declaration to this effect. The communication can be sent, within the same period, by fax or email to info@stagnittacaffe.it or by phone to Customer Service at +39 091547317.

2. Stagnitta will contact the Customer to arrange the return.
   The return of the product must take place within 14 days from the date of receipt of the withdrawal notice.
   The refund of the purchase price does not include shipping costs.
   If the product's value has decreased due to manipulation other than what is necessary to establish its nature, characteristics, and functioning (e.g., damaged products, not properly or fully packaged, or missing/damaged parts like components, elements, accessories, packaging materials, boxes, documentation, etc.), Stagnitta will refund the Customer the purchase amount minus the value of this decrease.
   If the Customer returns products after the deadline or if the products are opened and/or partially used and cannot be returned, the right of withdrawal does not apply, and Stagnitta will return the purchased goods to the Customer, charging the return shipping costs.
   Subject to the above limitations, Stagnitta will refund the actual amount paid by the Customer within 14 days of receiving the withdrawal notice via credit note to the bank account or credit card.

Warranty
All products, except for food items, sold by Stagnitta are covered by the manufacturer's warranty and the 24-month warranty for defects of conformity as per Legislative Decree 24/2002 and subsequent amendments and Articles 130 and 132 of Legislative Decree 206/2005. To avail of warranty assistance, the Customer must retain the invoice, or in the absence of one, the delivery document.
If the purchased product is defective or damaged during transport, the Customer can request a replacement within a strict 10-day period from receipt by telegram, email to info@stagnittacaffe.it, or phone communication to Customer Service at +39 091547317. The Customer must also return the defective or damaged product in its original packaging, intact in all parts.
In case of replacement, return shipping costs will be covered by Stagnitta. Stagnitta will replace the product with an identical one or, in case of stock depletion and with prior agreement with the Customer, with one of equivalent value.

Applicable Law and Competent Court
The sale of products and/or services takes place within the Italian territory and is governed by the laws in force in the Italian Republic. The competent court for resolving any disputes will be the one specified by the current Italian legislation at the time the contract is concluded.

This tool can be used by the European Customer for out-of-court resolution of any dispute arising from the purchase of products on www.caffestagnitta.com. Stagnitta is available to respond to any inquiries sent via email to info@stagnittacaffe.it.
